Terms — plain-ish English

The rules of the road.

Accepting these terms

By creating an account or using Codeanimate (codeanimate.dev, "the Service"), you agree to these Terms of Service. If you don't agree, don't use the Service.

You must be at least 13 years old to use the Service. If you're using the Service on behalf of a company or other organization, you represent that you have authority to bind that entity to these terms.

Accounts

Some features require an account. You're responsible for keeping your credentials confidential and for activity that happens under your account. Let us know right away if you think your account has been compromised.

One person, one account. Don't share accounts or create accounts on behalf of someone else without their permission.

Plans, billing, and cancellation

Free tier. The free tier is free to use, with the export cap and watermark described on the pricing page. No card required.

Pro subscription. Pro is a recurring paid subscription billed through Stripe. By subscribing you authorize us to charge your payment method on each renewal until you cancel. You can cancel at any time from your account; your Pro features remain active through the end of the current billing period, and you won't be charged again.

Refunds. We don't generally issue refunds for partial months, but if something has gone wrong, email us and we'll do what's fair.

Price changes. If we change the price of Pro, we'll give existing subscribers at least 30 days' notice by email. You can cancel before the change takes effect.

Your content

You own the code, snippets, themes, and animations you create with the Service. We don't claim ownership of your content, and we don't use it to train machine-learning models.

If you save a project to the cloud on Pro, you grant us a limited license to store, copy, and transmit that content solely for the purpose of operating the Service (for example, syncing projects between your devices). That license ends when you delete the project or your account.

You're responsible for making sure you have the rights to the code and other content you put into the Service.

Acceptable use

Don't use the Service to:

  • Break the law, infringe someone's intellectual property, or violate someone's privacy.
  • Upload malware, exploit code intended for unauthorized access, or content designed to harm or deceive others.
  • Harass, threaten, or impersonate others, or produce content that sexualizes minors.
  • Interfere with the Service — for example, by trying to reverse-engineer our infrastructure, probe for vulnerabilities without permission, or circumvent rate limits or the free-tier export cap.
  • Resell the Service, or use it to build a product that competes directly with it.

Security researchers acting in good faith are welcome — email us before testing anything that might affect other users.

Our intellectual property

The Service itself — the code we wrote, the branding, the site design — belongs to us or our licensors. These terms don't grant you any rights in our trademarks or brand. Open-source libraries included in the Service are governed by their own licenses.

Third-party services

The Service uses third-party providers (including Clerk for authentication, Stripe for billing, and Cloudflare for hosting). Your use of those providers, where they interact with you directly, is also governed by their own terms and privacy policies.

Suspension and termination

You can close your account at any time by emailing bradh11@gmail.com.

We may suspend or terminate your access if you violate these terms, if your account is used to harm the Service or other users, or if we're required to do so by law. Where possible, we'll give you a chance to fix the issue first.

Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that exports will always complete successfully.

Limitation of liability

To the fullest extent permitted by law, Codeanimate and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of USD $50 or the amount you paid us in the twelve months before the claim arose.

Indemnification

You agree to indemnify and hold us harmless from any claims or demands — including reasonable legal fees — made by any third party arising out of your content, your use of the Service, or your violation of these terms.

Changes to the Service and these terms

We may update the Service and these terms over time. When we make material changes to the terms, we'll update the "Last updated" date at the top of this page and notify subscribers by email. Continuing to use the Service after changes take effect means you accept the updated terms.

Governing law

These terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising from these terms or the Service will be resolved in courts located in the United States, and you consent to that jurisdiction.
